1. Introduction

2. License Agreement

1. What am I Purchasing? When you purchase one of our sample libraries you are NOT obtaining OWNERSHIP of the sounds in the library. Ownership remains with Sample Market. You are purchasing a LICENCE to use the sounds within your musical compositions, whether or not your compositions are released commercially. Copying, duplication, lending or re-selling of this product or its contents in whole or part are strictly prohibited. Once purchased your license is NONTRANSFERABLE which means that the license is authorized only to the original purchaser. You are not permitted in ANY way to share the purchased sample library with others.

2. How can I use the sounds? Once you have purchased one of our sound libraries you have a single user license which permits you to use sounds from that library with combination with others sounds in your own music productions (which include soundtracks such as films, video productions, radio/TV programs or commercials, computer games and multimedia presentations, public performances and other reasonable musical purposes within musical compositions). You may release such productions commercially without payment of any further royalties or fees for such usage. You MAY NOT use the sounds and MIDI files in isolation as sound effects (i.e. a sequence of musical events) or within any competitive products that are sold or relicensed to multiple third parties. For example, you are not authorized to create another sound library, sample-based instrument, or VST, or to train an AI model synth instrument with any of the sounds from our products. Doing so will infringe copyright law, and you will be liable for prosecution under copyright, design, and patent laws.

3. Usage and Copyright

Copying, re-selling, leasing, duplicating or distribution in any form of the products for sale, other than outlined in the ‘License Agreement’, is strictly prohibited. This extends but is not limited, to file sharing websites, web forums, computer networks and file hosting websites. Products cannot be distributed in their original format or sold in a manner that would be considered competitive with the nature of Sample Market business, outlined in ‘About Sample Market’ Everything else on the website is licensed to Sample Market, including artwork, source code, materials, audio demos, graphics, text and logos and protected by copyright and intellectual property laws.

4. Limitations Of Liability

You acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website. Whilst we endeavour to ensure that the and excluded to the maximum extent permitted under applicable law. 5. The Right To Challenge A Transaction

Sample Market reserves the right to challenge the legal standing of a transaction under sufficient circumstances. In such a case the user will be contacted by Sample Market staff individually to confirm his/her identity. Failure to verify a user’s identity will result in cancelling the challenged order. A challenged order is open for validation for 30 days after the transaction.

8. Entire Agreement

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website and supersede all previous agreements in respect of your use of this website.

9. Law And Jurisdiction

This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.

10. Payments and Prices

We offer SECURE online shopping powered by Braintree and supporting all major credit and debit cards including VISA, Mastercard and Amex. We also accept PayPal.

Payment will be taken from the Credit or Debit Card (or through PayPal) that you have provided when you register. You will not receive any download links until full payment is received. All prices are inclusive of VAT and are subject to change from time to time. All payments on Sample Market are made in British Pounds Sterling. Our online shop presents prices in 4 currencies to assist decision-making in regard to the purchase. The currency displayed is solely based on your territory of sale. These currencies are British Pound (GBP), Euro (EUR), Japanese Yen (JPY) and US Dollar (USD). The prices displayed in currencies other than GBP are only an approximation and the actual exchange rates applied by the banks at the time of purchase may vary. You are responsible for payment of all applicable currency exchange and other bank charges

Prices and availability of Content offered through the Website are subject to change at any time without notice. Sample Market does not provide price protection or refunds in the event of a price drop or promotional offering.

11. Refund Policy

1. No Refunds, Exchanges, or Store Credits:

All products, once purchased and downloaded, are non-refundable.

Further, we do not provide refunds, exchanges, or store credits in the following situations:

  • You no longer need the purchased product.
  • You cannot use the product due to hardware or software limitations (i.e., you do not own compatible software for the product).
  • You have changed your mind or found an alternative product.
  • You made an incorrect product selection (i.e., purchased and downloaded the wrong product).
  • We do not make any guarantees for product use with cracked or illegally downloaded software.
  • You cannot use the product due to insufficient knowledge/know-how.

Please be sure to make informed purchases, as mistakes cannot be considered reasons for refunds, exchanges or store credits. Please listen to the demos, read the product descriptions, and review software requirements carefully before making a purchase.

Each product is clearly labeled with its content and software requirements. The customer is responsible for having the knowledge required to use the product.

2. Exemptions:

Refunds may only be considered under the following circumstances:

a. Duplicate Purchases: We are happy to issue a refund or a store credit for duplicate purchases. Please provide evidence of the duplicate purchase.

b. The zip file has not been downloaded * : We are happy to issue a refund if our system has not registered a download – i.e., you have not attempted a download by clicking on the download link issued to you.

3. Refund Request Process:

To request a refund under the exemptions mentioned above, please contact our customer support at support@samplemarket.co.uk within 30 days from the date of purchase (found in your Order Confirmation Email). Provide detailed information about the issue, including your order number, the name of the product, and a description of the problem.

* A Download counts as such when a download action is commenced (and not completed). We do not monitor the completion of the download. Each click on the download link counts as one download attempt.

12. Digital Gift Cards

11.1. Gift cards may only be redeemed at our website, samplemarket.co.uk.
11.2. Gift cards cannot be used to pay for other Sample Market gift cards.
11.3. Gift cards will expire 1 year from the date of receipt. (if there’s an expiration date)
11.4. If the redeeming order exceeds the amount of the gift certificate, the balance must be paid by Paypal, credit or debit card.
11.5. Sample Market reserves the right to cancel any gift cards in its sole discretion where fraud or misuse is suspected.

13. Disclaimer and Waiver

Sample Market will be held harmless against any losses, judgements, claims, legal fees or court costs that may arise out of a breach of these terms and conditions. By entering this agreement, you agree not to sue or recover any damages from Sample Market and any affiliated companies or people as a result of its decision to terminate or suspend this agreement. Whilst Sample Market will take reasonable and sufficient steps to ensure that the website is free from any viruses, trojans, malware, spyware, harmful software, data theft or any unauthorised malicious activity, Sample Market make no guarantees on this subject and will not be held liable for any loss resulting from this.
